The short version, in plain English.

This website tells you about our clinic. It does not diagnose you, treat you, or replace a visit. Reading it does not make you our patient. Nothing here is a promise about your results. If something is wrong with you, come in or call (321) 751-1414. If it is an emergency, call 911. The sections below say all of this again, more carefully, because that is what terms of use are for.

1. Accepting these terms

These Terms of Use (the "Terms") govern your access to and use of the website at eaumed.com (the "Site"), operated by Eau Gallie Medical Center ("we," "us," "our," the "clinic").

By visiting, browsing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. If you use the Site on behalf of someone else, you confirm you are authorized to accept these Terms for them.

These Terms govern the website. They do not govern the medical care we provide. Treatment is governed by the consents, financial agreements and notices you sign at the clinic, and by the professional and legal duties every physician owes a patient. Nothing in these Terms limits those duties, and nothing here waives any right you have as a patient.

2. No medical advice

The Site is informational only. Everything on it, service descriptions, the pricing list, the pages about weight loss, aesthetics, peptide therapy, medical marijuana, Suboxone and medication-assisted treatment, supplements, and any other content, is general information about what our clinic offers. It is not medical advice, not a diagnosis, not a treatment recommendation, and not a substitute for a consultation with a qualified healthcare professional who has actually examined you.

General information cannot account for your history, your medications, your allergies, your test results or your circumstances. Only a clinician who evaluates you can do that.

  • Do not use the Site to self-diagnose. Symptoms overlap; serious conditions imitate minor ones.
  • Do not delay or disregard professional medical advice because of something you read here.
  • Do not start, stop or change any medication, dose or treatment, including supplements, based on this Site. Talk to a clinician first.
  • Always seek the advice of your physician or another qualified provider with any question about a medical condition.

References to a treatment, medication, product or supplement on the Site are descriptions of services we offer. They are not endorsements for your situation, and they are not a representation that any particular treatment is appropriate, effective or available for you.

3. No doctor-patient relationship

Using this Site does not create a doctor-patient, provider-patient or any other professional relationship between you and Eau Gallie Medical Center, Dr. Michael Wolfington, Natalie Best, APRN-BC, or any other provider or staff member.

That relationship begins only when you are seen and accepted as a patient at the clinic (or through a properly established telemedicine visit) and the necessary paperwork and consents are completed. Until then:

  • Browsing the Site, reading a service page or opening a pricing list creates no relationship.
  • Calling the clinic to ask a question creates no relationship.
  • Sending an email or leaving a voicemail creates no relationship, and no one is monitoring either one continuously. Never rely on an unanswered message.
  • We are under no obligation to respond to any message sent through the Site, and a response does not by itself create a relationship or constitute medical advice.

Please also remember that messages sent through the Site or by email are not secure. Our Privacy Policy explains this, and asks you not to send health details through either.

4. Emergencies

Call 911 for any medical emergency.

Do not use this Site, email, voicemail or social media to report an emergency or an urgent change in your condition. Those channels are not monitored around the clock and may not be seen for some time. If you are experiencing chest pain, difficulty breathing, signs of a stroke, severe bleeding, a serious injury, an overdose, or thoughts of harming yourself or others, call 911 or go to the nearest emergency department immediately.

The 988 Suicide & Crisis Lifeline is available 24 hours a day by calling or texting 988.

We are a walk-in clinic and an urgent care provider during posted hours; we are not an emergency room, and we are closed outside those hours.

5. Permitted use of the site

We grant you a limited, personal, non-exclusive, non-transferable and revocable license to access and use the Site for your own non-commercial purposes: learning about our services, finding our hours and location, and contacting us. You agree not to:

  • Use the Site for any unlawful purpose, or in any way that could damage, disable, overburden or impair it.
  • Submit false, misleading or fraudulent information, or impersonate anyone when contacting us.
  • Use any contact method to send spam, solicitations or bulk messages.
  • Attempt to gain unauthorized access to the Site, its hosting infrastructure, or any connected system or account.
  • Introduce viruses, malware or any other harmful code.
  • Use robots, scrapers, or automated means to harvest content or contact details from the Site, or to circumvent any anti-spam measure.
  • Copy, reproduce, republish, frame, mirror or redistribute the Site's content except as Section 6 allows.
  • Reverse engineer or attempt to derive the source of any part of the Site beyond what your browser does in ordinary use.

We may restrict or terminate access to the Site at any time, for any reason, without notice.

6. Intellectual property

The Site and its contents, text, photographs, illustrations, graphics, logos, page design, layout and code, are owned by Eau Gallie Medical Center or its licensors and are protected by United States copyright, trademark and other intellectual property laws.

You may view the Site, and print or download a copy of a page for your own personal, non-commercial reference, for instance, to bring our hours or pricing to an appointment. Any other use requires our written permission. The "Eau Gallie Medical Center" name and logo are our marks; other names and marks appearing on the Site, including those of third-party products and brands, belong to their respective owners, and their appearance is not an endorsement by or of us.

Photographs of our providers, staff and clinic may not be reproduced. If you believe material on this Site infringes your copyright, contact us using Section 17 with enough detail to identify the work and the page, and we will investigate promptly.

7. Accuracy, pricing and availability

We try to keep the Site accurate and current, but we do not warrant that it is. Content may contain errors, omissions or outdated information, and we may change, correct or remove any part of it at any time without notice.

Prices on this Site are estimates, not a binding quote or an offer.

The prices shown are self-pay reference prices for common services, published in good faith to help you plan. They may change without notice, and they do not include every service, lab, medication, supply or follow-up you may need. Your actual cost depends on what you need once you are evaluated, and, if you use insurance, on your plan, your deductible, your co-insurance and your coverage. Nothing on this Site is a guarantee of price, coverage or insurance acceptance. Please confirm current pricing with the front desk before your visit. If you are uninsured or not using insurance, you also have the right to a written Good Faith Estimate.

Our scheduling line, (321) 241-2013, is answered by an automated assistant provided by an outside company; those calls are recorded and transcribed, and you can ask for a person at any time. Posted hours, providers, services and appointment availability can change. Holidays, staffing and unforeseen closures happen. Call (321) 751-1414 to confirm before making a trip, particularly for anything time-sensitive. We do not guarantee the Site will be available without interruption or error, and we may modify or discontinue it at any time.

8. Notes on specific services

8.1 Telemedicine

Telemedicine visits are offered under Florida law to patients located in Florida at the time of the visit, at our clinical discretion, and only where a remote visit is medically appropriate. Not every condition can be assessed remotely, and a clinician may end a telemedicine visit and ask you to be seen in person. Telemedicine visits do not take place on this Site; they are arranged through the clinic.

8.2 Aesthetics, weight loss and wellness services

Individual results vary, and no result is guaranteed. Before-and-after descriptions, treatment descriptions and any outcome mentioned on the Site or in consultation are not promises. Aesthetic treatments, weight-loss programs, peptide therapy and supplement recommendations all carry risks and are appropriate only for some people. Suitability, the plan, the number of units or syringes, and the expected outcome are determined at an individual consultation after evaluation, never from this website.

8.3 Suboxone and medication-assisted treatment

Our MAT and Suboxone information describes a program we offer. It is not a prescription, not a guarantee of admission, and not clinical guidance for managing withdrawal or dosing on your own. Treatment requires evaluation, informed consent and ongoing clinical supervision. If you are in crisis or believe you are overdosing, call 911. The SAMHSA National Helpline is free, confidential and available 24/7 at 1-800-662-4357.

8.4 Supplements

Dietary supplements, including those available through the practitioner dispensary we link to, are not drugs. Statements about supplements have not been evaluated by the U.S. Food and Drug Administration, and no supplement is intended to diagnose, treat, cure or prevent any disease. Supplements can interact with prescription medications and are not right for everyone, particularly if you are pregnant, nursing or managing a chronic condition. Talk to a clinician before starting one.

8.5 Medical marijuana

Any information about medical marijuana certification describes a service offered in accordance with Florida law and is subject to eligibility requirements, state registration and clinical judgment. It is not a guarantee of qualification or certification.

9. Third-party links and products

The Site links to services we do not operate, including Facebook, Instagram, Google Maps and the Designs for Health practitioner dispensary. Those links are provided for convenience only. We do not control, endorse, monitor or take responsibility for the content, products, services, availability, security or privacy practices of any third-party site, and your use of them is at your own risk and subject to their terms.

Products ordered through the linked supplement dispensary are sold, priced, fulfilled, shipped and supported by that third party under their terms and their return policy. Your purchase contract for those products is with them, not with us, and we are not responsible for those transactions.

Anything you post on our social media pages is public and governed by that platform's rules. Please do not post health details there; contact the clinic directly instead.

10. Privacy

Our Privacy Policy and Cookie Notice explain what this Site collects and how it is handled, and they are incorporated into these Terms. In short: the Site sets no cookies, runs no analytics, and never asks for personal information (its hosting provider automatically receives basic technical data such as IP addresses; see the Privacy Policy). Email and social media are not secure channels, so please do not send medical information that way. Health information the clinic holds about you as a patient is protected under HIPAA and described in our Notice of Privacy Practices, which is also available at the front desk.

11. Disclaimer of warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure or error-free; that defects will be corrected; that the Site or its server is free of viruses or other harmful components; or that the content is accurate, complete, current or reliable. You use the Site at your own risk.

This section applies to the website. It does not disclaim, limit or waive any duty we owe you as a healthcare provider, and it is not a waiver of any claim relating to medical care.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EAU GALLIE MEDICAL CENTER AND ITS OWNERS, PROVIDERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF: OR INABILITY TO USE: THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This includes, without limitation, damages arising from: reliance on information found on the Site; errors, omissions or outdated content; a phone message or email that is delayed, misdirected, intercepted or never received; interruption or unavailability of the Site; or anything reached through a third-party link.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

What this section does not do.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by negligence. In particular, this section does not limit our liability for medical care, and it is not a waiver of any medical malpractice claim. It concerns the website. Some jurisdictions do not allow certain exclusions or limitations, so parts of these sections may not apply to you, and you may have rights that these Terms cannot take away.

13. Indemnification

You agree to indemnify, defend and hold harmless Eau Gallie Medical Center and its owners, providers, employees, contractors and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site, your violation of these Terms, your violation of any law, or your infringement of any third party's rights. This does not apply to claims relating to the medical care we provide.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to the jurisdiction and venue of those courts.

Before filing anything, please contact us, most concerns are resolved with a phone call. This section applies to disputes about the website; disputes concerning medical care are governed by Florida law applicable to healthcare claims, including its own pre-suit requirements.

15. Accessibility

We want this Site to be usable by everyone, including visitors who use screen readers, keyboard navigation, magnification or reduced-motion settings. It has been built with semantic structure, text alternatives for meaningful images, visible focus indicators, and animations that switch off when your device asks for reduced motion.

We do not claim formal conformance with any particular standard. If any part of this Site is difficult for you to use, or if you need information from it in another format, call (321) 751-1414 and we will provide it another way and work to fix the problem. Accessibility barriers at the clinic itself should be raised with our front desk so we can accommodate you.

16. General terms

Changes to these Terms
We may revise these Terms at any time by posting an updated version with a new "Last updated" date. Continuing to use the Site after a change means you accept it. Please check back periodically.
Severability
If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary, and the rest stays in force.
No waiver
Our failure to enforce any provision is not a waiver of it.
Entire agreement
These Terms, with the Privacy Policy and Cookie Notice, are the entire agreement between you and us about the Site. They do not replace any treatment consent, financial agreement or notice you sign as a patient, if those conflict with these Terms, the patient documents control.
Assignment
You may not assign these Terms. We may assign them in connection with a transfer of the practice.
Survival
Sections 2, 3, 6, 11, 12, 13, 14 and 16 survive any termination of your use of the Site.
Geographic scope
The Site is intended for visitors in the United States, and our services are provided in Florida. We make no representation that the content is appropriate or available elsewhere.

Questions about these Terms:

Eau Gallie Medical Center
1403 Highland Avenue
Melbourne, FL 32935

Phone: (321) 751-1414

For medical questions, please call or come in rather than email. For a medical emergency, call 911.

Please read: this is a template, not legal advice.

These Terms of Use were prepared as a starting point for Eau Gallie Medical Center's website and were written to match what the website actually does. They were not written by an attorney and are not legal advice.

Limitation-of-liability and indemnification clauses are enforced differently from state to state, and a healthcare provider's ability to limit liability is narrower than an ordinary business's: Florida law restricts what a medical practice may disclaim, and some clauses in a generic template can be unenforceable or counterproductive for a clinic. Have a licensed Florida attorney review this page before relying on it, particularly Sections 11 through 14, and confirm it is consistent with your malpractice coverage and your patient consent documents.

Update these Terms whenever the Site's capabilities change, for example if you add online booking, payments, a patient portal or a chat tool.
